1. What you are agreeing to

By installing or using the Android app Fairest Heart (“the app”) you agree to these terms and to the privacy policy. If you do not agree, do not use the app.

2. Not a medical device

The app records, displays and exports the data your Polar H10 chest strap provides. It does not analyse your heart rhythm, makes no statement about your health, and is not a medical device under any law. Nothing in the app, in its files or on this site is medical advice. If you are worried about your heart, see a clinician. In an emergency, call your local emergency number.

3. What you need

A Polar H10 chest strap and an Android phone that meets the requirements on the Help page. The strap is a product of Polar Electro Oy and is sold under its own terms. We have no relationship with Polar.

4. Licence

We grant you a personal, non-transferable licence to use the app on Android devices you own or control, under the terms of Google Play. You may not copy, modify, reverse-engineer, resell or redistribute the app except where the law allows it regardless of this clause. The recordings the app makes are yours.

5. Plans and purchases

• Free, Plus and Pro differ in how long the app keeps recordings and what it can make from them, as described on the Plans page. Every plan records and shows the same signal.
• Subscriptions are sold and billed by Google Play, renew automatically until cancelled in Google Play, and follow Google Play's refund rules. Cancelling stops the next renewal; the current period runs to its end.
• When a plan ends, the app keeps every recording for 30 days before the Free limit applies. Copies in your Download folder are never touched by a plan change.
• Support purchases are one-time gifts. They unlock nothing, are not refundable by us, and follow Google Play's rules.
• A tester code unlocks features on one phone for a limited time. It may be withdrawn and gives no right to a refund.

6. Your recordings and your responsibility

The app stores recordings on your phone and copies them to the phone's Download folder. You are responsible for keeping, backing up and sharing them, and for whom you share them with. We cannot recover a recording you have deleted or a phone you have lost.

7. No warranty

The app is provided “as is”. Bluetooth drops, a dry strap, a phone that stops background work or a bug can leave gaps in a recording or stop it. We do not promise that any recording is complete, continuous or fit for any purpose, and we do not promise uninterrupted availability of any feature.

8. Limitation of liability

To the extent the law allows, Fairest Media LLC is not liable for any indirect, incidental or consequential loss, or for any decision made or not made on the basis of what the app recorded or showed. Our total liability for any claim is limited to the amount you paid us through Google Play in the twelve months before the claim.

9. Third-party software

The app includes open-source components under their own licences, listed on the app's Help → Licences page.

10. Changes and ending

We may update these terms; the new version is published here with a new effective date, and material changes are noted in the app. You may stop using the app at any time by uninstalling it. We may end the licence if you break these terms.

11. Governing law

These terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law rules. Mandatory consumer protections of the country you live in are not affected.
